Legal basis for using KI DEVment

Welcome to KI DEVment. These Terms and Conditions govern the use of our website and open-source software. Please read these terms carefully before using our services.

§ 1 Scope of Application

These Terms and Conditions apply to all users of the website kidevment.com and the open-source software KI DEVment. The operator of the website is Thomas Schärer, Ebentaler Straße 100A, 9020 Klagenfurt, Austria (hereinafter referred to as "Operator").

§ 2 Service Description

KI DEVment is an open-source software platform for automated software development using Artificial Intelligence. The software is provided free of charge. The Operator does not offer guaranteed services or support obligations. Use is at your own risk.

§ 3 Open Source License

The KI DEVment software is released under an open-source license. The source code is publicly accessible and may be freely used, modified, and distributed according to the license terms. Specific license terms can be found in the repository.

§ 4 Usage Rights and Restrictions

Users are granted a non-exclusive, non-transferable right to use the software. It is prohibited to use the software for illegal purposes, to violate third-party rights, or to distribute malware. Users are obligated to respect applicable laws and third-party rights.

§ 5 Disclaimer of Liability

The software is provided "as is" without warranty of any kind. The Operator assumes no liability for direct, indirect, incidental, or consequential damages arising from the use or inability to use the software. This includes particularly data loss, profit loss, or business interruption.

§ 6 Warranty and Defect Liability

No warranty is provided for the free open-source software. Liability for defects is excluded to the extent permitted by law. Users are expressly advised to thoroughly test the software before productive use.

§ 7 Data Protection

The protection of personal data is important to us. For information on data processing, please see our Privacy Policy. When using local AI features (Ollama), all data remains on the user's device. The Operator has no access to this data.

§ 8 Copyright and Intellectual Property

All content on this website (texts, images, logos) is protected by copyright. The open-source software is subject to the terms of its respective license. Third-party trademarks and names are used with acknowledgment of their rights.

§ 9 Contact Form and Communication

Data transmitted via the contact form is stored and processed to handle the inquiry. Submission is voluntary. Data will not be passed on to third parties and will be deleted after the communication is concluded, unless legal retention obligations exist.

§ 10 Changes to Terms

The Operator reserves the right to change these Terms and Conditions at any time. Changes will be published on this page. Continued use of the website or software after changes constitutes acceptance of the new terms.

§ 11 Severability Clause

Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. An invalid provision shall be replaced by a valid provision that comes closest to the economic purpose.

§ 12 Applicable Law and Jurisdiction

These Terms and Conditions are subject to the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For disputes arising from or in connection with these Terms, the court in Klagenfurt am Wörthersee shall have jurisdiction, to the extent permitted by law. For consumers, the statutory place of jurisdiction applies.

§ 13 Consumer Information

§ 14 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. The Operator is not obligated to participate in dispute resolution procedures before a consumer arbitration board.
